Saifuddin Nasution’s announcement on reopening investigation of Pastor Raymond Koh and Amri Che Mat is applauded. Cabinet is urged not to proceed with the appeal of the high court’s decision

I welcome the statement by Minister of Home Affairs, YB Datuk Seri Saifuddin Nasution that the police will reopen investigations into the disappearances of Pastor Raymond Koh and Amri Che Mat, cases in which several policemen were previously implicated.
However, I note with concern the Government’s decision, through the Attorney General’s Chambers (AGC), to file an appeal against both liability and quantum in the civil suits brought by the families of Pastor Koh and Amri.
The High Court, after hearing full evidence and witness testimonies, made a clear and reasoned finding that the Royal Malaysia Police were responsible for the enforced disappearances.
By appealing against liability, the Government appears to be challenging the Court’s factual and legal findings, which effectively implies that the police were right and the learned judge was wrong. This is inconsistent with the Home Minister’s announcement to reinvestigate the cases and raises serious questions about the Government’s commitment to truth, transparency, and justice.
I urge members of the Cabinet to discuss this matter in the Cabinet meeting today and direct the AGC not to appeal against the decision of the High Court. At the most if an Appeal is strongly urged by the AG, then it should only be on the quantum.
