Wendy’s Sad Story

I am handling a messy case now. Part of the mess was created by the improper handling of Michael Chong on this case.

The story started when Wendy, an under-age girl, had sex with a 18-year-old guy Sow Kien Siong after knowing him through the internet in mid January this year.

They went out for about a week and broke up after that. She then found herself pregnant. Her father beat her up badly, forced her to marry Sow despite her strong objections. She was also told to abort the baby.

Wendy then married Sow under duress. Before and after her wedding, she has told Sow that the baby, Sow Zhi Kian, doesn’t belong to him but belong to her earlier boyfriend whom she cannot locate now. He has accepted it.

After being married for a few months, Sow told Wendy that he is in love with another woman and said he would like to marry her but she will still be the ‘first wife’. He has also beaten her and threw her mobile phone on the floor. She then decided to leave him.

One day when her aunty came to visit her and her baby at the husband’s house, the aunty took the baby and ran away with Wendy.

Sow and his mother then went to complain to Michael Chong. Michael Chong called both parties to his office, he said Wendy can have the guardianship of the baby and asked Wendy to sign an agreement to allow Sow to visit the baby twice in a month.

Wendy claimed that she was forced to sign the agreement because Michael Chong threatened to send her to rehab home if she refused to do so. Wendy told Michael Chong that Sow is not the biological father of the baby boy but Michael Chong refused to believe her.

She signed the ‘agreement’ but refused to honour it. When Sow and his mother failed to contact her, they then went to Michael Chong again. Michael Chong called a press conference to ask Wendy to bring the baby back. I

In that press conference, they even alleged Wendy’s aunty may be trying to sell the baby.

After the news came out, Wendy, her mother and her aunty came to to seek help from me. They denied all the allegations made against them and they wanted to clear their names, especially on the part of selling baby. Below are their police reports:

Saya kenal Sow Kien Siong melalui Internet. Saya mengadakan hubungan seks dengannya pada 18/1/2007. Selepas itu, saya diapksa oleh bapa saya untuk berkahwin dengan Sow Kien Siong mengikut adat orang Cina pada 27/5/2007. Pada waktu itu, saya sudah berhamil 7 bulan. Anak saya Sow Zhi Kian dilahir pada 16 Julai 2007.

Saya ingin menegaskan bahawa anak bayi saya Sow Zhi Kian bukan anak kepada Sow Kien Siong. Saya telah meninggalkan rumah Sow Kien Siong pada 19 Oktober 2007 bersama dengan anak bayi saya Sow Zhi Kian secara sukarela, kerana saya amat tidak puas hati terhadap sikap suami saya dan ahli keluarganya terhadap saya.

Suami saya telah mengadakan hubugan dengan wanita lain. Beliau juga pernah memukul saya dan laporan polis telahpun dibuat pada 19-10-2007 bersangkut Setapak Repot: 10650/07. Tujuan laporan ini dibuat adalah untuk rujukan mahkamah kerana saya tidak mahu Sow Kien Siong datang kacau saya dan saya tidak mahu beliau mengambil anak saya. Sekian laporan saya.

Pada 16/11/2007 jam lebih kurang 0800 hrs semasa saya berada di rumah XXXX, saya telah membac surat khabar China Press dan terbaca satu artikel dari satu siding akhbar oleh Michael Chong (MCA) bersama(1)(L)Cina bernama Sow Kien Siong mengatakan bahawa saya serta suami bernama Foo Fook Wong telah terlibat dalam penjualan bayinya yang berumur 4 bulan.

Sow Kean Siong adalah suami kepada anak saudara saya yang bernama Wendy Lim She Wei.

Tujuan saya membuat laporan ini adalah kerana saya tidak berpuas hati dengan tuduhan tersebut dan ingin menafikan tuduhan Michael Chong serta Sow Kien Siong.

Bayi tersebut masih berada bersama dengan anak saudara saya iaitu Wendy Lim She Wei dan keluarganya.

We held a press conference last Saturday to clarify the above matter.

Michael Chong Whacked Me
On Monday, Michael Chong called a press conference together with Sow Kean Siong and his mother. Michael whacked me for being unprofessional. He said my press conference has exposed Wendy’s unpleasant background to public. He said that I just intended to go for him and not settling the matter. He said he has found the best solution that resolved the conflict of two families. He said I have politicised the case, and broke the couple apart. Sow then said that he prepared to accept Wendy and his baby again.

I was told that The Star has carried the story, but the news report did not get my statement at all :-((

My Rebuttal

I called a press conference yesterday together with Wendy, her mother and her aunty and uncle. I encouraged Wendy to speak up and tell her story.

She said Michael Chong forced her to write the agreement. She insisted on having a DNA test to ascertain whether the baby belongs to Sow or not. She then repeated her story again in the media. Her tears flew when she mentioned about her father forcing her to marry Sow, and she doesn’t love Sow anymore because he is lazy and he has another woman.

A few reporters from Chinese press who came for the press conference were quite harsh in their questioning. This is because they have listened to Sow’s version in Michael Chong’s press conference earlier.

I then made my comment to the media. I said, it was Wendy and her family who came to me to ask me to call a press conference to clear their name on the accusation of selling away the baby. So I decided to give them a platform to do so.

Legally speaking ..
I told the media that Wendy and Sow were not bound in a legal marriage because they just have gone through the Chinese matrimonial ceremony, and their marriage is not registered. So, legally speaking, Sow is not her husband. Under the Law Reform (Marriage & Divorce) Act 1976, after the appointed date (date of coming into force of the Act i.e 1 March 1982), marriages have to be solemnised by a Registrar of Marriages, i.e customary marriages after the appointed date are not recognised by law. The Act preserves the status of customary marriages entered into before the appointed date.

Besides, when she has sexual intercourse with Sow, she was still under age, both Sow and her former boyfriend can be charged in court and be jailed if we want to get the police involved in the case. So Wendy as a single parent, she has sole guardianship over her baby. Sow has no right to demand visit to the baby because the baby doesn’t belong to him.

Michael Chong Has Acted In An Unprofessional Manner
I said, when Michael Chong took up the case and when Wendy told Michael Chong that the baby doesn’t belong to Sow, he should have asked them to do DNA test to ascertain whether Sow is the biological father of the baby, and not to ask Wendy to sign the agreement and allow Sow to visit the baby etc. This is where the problem started.

Failing to listen to both sides of the story showed Michael Chong has acted in a very unprofessional manner.

We should not let mistakes be continued
I said Wendy and her father have made grave mistakes in the whole episode. First of all, she should not have entered into sexual relationship with men whom she has gone out with, especially when she was under-aged. Secondly, her father should not have forced her to marry Sow and she should not have agreed at all. Thirdly, outsiders like Michael Chong and the society should not have forced her to ‘re-unite’ with Sow again because she doesn’t love him anymore.

I said the best way is to do DNA test for the baby, and Wendy’s family agreed to pay the amount of RM1,500 for DNA test because Sow’s family refused to share the fee.

After the press conference, I then took them to extract blood from a clinic and sent their blood samples to Chemistry Department in PJ. That baby boy was so cute, he has been keeping quiet while we had our press conference in the morning. It was really heart-breaking when we heard him crying painfully when the doctor tried to extract blood from his little hand.

I hope Sow can be cooperative and send his blood sample to Chemistry department. I pray that the result can prove Wendy is correct, and I pray that she can start a new life after that.

I am arranging her and her mother to move to a shelter home for the time being. I will also try to arrange counseling for her and her mother. After this heart-breaking process, their hearts need to be comforted and healed.

I am amused to see the front page of China Press that carried our press conference today. It carried the photo of Wendy Lim and Michael Chong. The heading next to wendy Lim is: You forced me to sign (the agreement); the heading next to Michael Chong is: You wrongly accused me.

（吉隆坡21日訊）“女方闖婆家搶男嬰案”糾紛升級！
此案女主角林淑薇今天指馬華公共服務及投訴部主任拿督張天賜，日前以送她進感化院為要脅，逼她簽下同意讓丈夫每月兩次抱回孩子的協議書。

她堅稱，當初是張天賜強迫她寫“協議書”，她是在身不由己下被迫就範。

“協議書的內容，是張天賜唸一句，我寫一句的！”

掌握證據

與此同時，當初介入協調此案的張天賜，今午獲知林淑薇在記者會上一再指責他后，聲稱被林淑薇誣賴，更怒斥這名少女“不識好歹”，在他背后插了一刀。

他強調，他手上掌握一切有力證據，包括當天雙方家長在他辦公室內洽談的經過及少女在母親指引下，親手寫下協議書的錄影及照片，所有在場人士都可證明。

“我當時是以太平局紳身分見證這份協議書，雙方父母也有簽名作證。若有人質疑這份協議書的可信度，可將此案帶上庭，由法庭來定奪！”

林淑薇：讓蘇吉祥死心
男嬰DNA決定關係

“一旦核氧核糖核酸（DNA）化驗報告，鑑定男嬰蘇志健（4個月大）不是蘇吉祥骨肉，雙方關係從此劃清界線，互不拖欠。”

“女方闖婆家搶男嬰”；女主角林淑薇今日再次現身記者會，堅稱她根本不曾愛過丈夫蘇吉祥。

16歲的林淑薇在家屬陪同下，今日出席由行動黨士布爹區國會議員郭素沁召開的記者會上，道出這番狠話。

除了林淑薇兩母子、其母親陳美娟、阿姨陳美麗夫婦也陪同出席，給予支持。

記者會上，林淑薇堅持要為嬰兒進行DNA化驗，希望蘇家給予配合，讓蘇吉祥弄清真相，死了一條心。

原本，她們希望男女雙方承擔這筆1500令吉的DNA化驗費，基于無法得到共識，女方最后決定一手承擔這筆費用。

在郭素沁陪同下，林淑薇即日便動身抽取血液樣本，為孩子進行DNA化驗。

女方也通過傳媒聯絡上男方的家婆袁秋鳳（43歲），對方起初指出，只要女方承擔所有的化驗費，同時找出所謂的孩子“生父”，才肯配合。

過后，女方指稱無法再找到孩子的生父，袁秋鳳則說再找馬華公共服務及投訴部主任拿督張天賜從長計議。

“一旦確定蘇吉祥并非孩子的的親生爸爸，我也會要求蘇吉祥必須和我倆母子劃清界線，從此互不相干。”

若報告證實蘇吉祥是孩子之父，在情義上，她允准蘇家每個月見孩子兩次。這也是她的底線。

案情 ：

去年年尾，蘇吉祥和在網上結識的林淑薇第一次見面即發生關係；3個月后，林淑薇告訴蘇吉祥懷了其骨肉，蘇吉祥也自願“負責”，以華人傳統婚姻方式迎娶林淑薇。

在孩子4個月大時，女方家人突然夜闖男家，將嬰兒抱走。雖然，女方較后答應讓男方每月看孩子兩次，最后竟出爾反爾，而引發賣嬰疑雲。女方最終現身澄清指孩子並非屬于

男方，男方僅是“便宜”爸爸，令此案案情錯綜複雜。

淑薇只愛孩子生父

林淑薇不愛蘇吉祥，因她心目中一直想著另一個“他”。

這個“他”不是別人，正是蘇志健的“生父”，該青年是來自蕉賴。

林淑薇今日在記者會上說，她無法找到孩子“生父”，只知道對方住在蕉賴，無法記得對方的住址。

她說，有次碰先這名男子，本想告訴對方是孩子的藍田種玉人，可是發現對方已另結新歡，只好作罷。

林淑薇阿姨陳美麗對《中國報》說，淑薇仍掛念及深愛這名男子，當淑薇發現對方有新戀情后，情願把真相藏起，也不願說出。

她說，儘管蘇家一直迫這名“生父”現身，可是林淑薇一直指稱不清楚對方的下落。

她說，外甥女此舉，明顯是護著這“生父”，不想對方捲入這宗風波，這也說明淑薇心中還有“他”。

證實非蘇吉祥兒子
可更改報生紙資料

林若輝律師指出，一旦脫氧核糖核酸（DNA）化驗結果，證實男嬰並非蘇吉祥的兒子，女方可拿著DNA報告前往國民登記局更改報生紙資料。

“只要報告確實無誤，女方就可以前往國民登記局，要求重新填上嬰兒生父的名字，但如以此案為例，女方沒有嬰兒生父的資料，嬰兒報生紙上父親一欄就空著。”

另一方面，郭素沁說，在法律角度，只要蘇吉祥不是蘇志健的父親，孩子撫養權自然歸給單親媽媽林椒薇。

在情在理上，蘇吉祥從此再也不能騷擾這對母子。

張天賜：或遭人唆使
原諒她年紀輕

張天賜非常不明白，為何少女到頭來竟指責被他強逼，相信此案必有不可告人內情，年少不更事的少女，很可能遭到唆使！

“我至今並沒有后悔處理此案，我也不會針對少女的談話報案，因為我知道她年紀尚輕，我始終會原諒他。”

他說，他當初處理此案，一直都是站在少女這邊，包括說服男方家人，讓少女家人照顧孩子，因為他體諒到女性懷胎十月產子的心情，同時年幼的孩童也最需要母親照顧。

他說，他費了口舌讓男方家人信服，甘願不再針對孩子的撫養權而爭吵，只是為了證明孩子的安全及不會被陌生人領養，甚至販賣，他才建議女方簽下協議書，讓男方一個月去探望兩次。

“這是非常合理的要求，一來讓女方全權照顧孩子，二來也可以讓孩子長大時，知道自己的父親是誰，這是最佳的結局，為何要弄至今時今日的地步，造成女方的貞節受損、孩子的父親也不知是誰，甚至少女與親父的關係也決裂。”

林淑薇：張天賜非開玩笑

林淑薇說，當初她們去找張天賜，是希望得到一個澄清的平台，卻遭張天賜迫寫協儀書，才會鬧到今天的地步。

也因為這個原因，她在求助無門下，找上郭素沁為她出頭。

她堅稱，她是百般不願地寫下這封協議書，因為張天賜說，若不簽協議書，她就被送進感化院，孩子則送進福利部。

她坦承，曾因為逃學，遭勃然大怒的父親兩度幾乎送進感化院改造；有關當局也曾警告她，若她再有任何差池，就會被關進感化院。

“所以，我有理由相信，張天賜不是和我開玩笑。”

免心懷不軌者圖獲利
或從法律角度追究

張天賜警告，就算林淑薇的孩子最終被證實不是與蘇吉祥所生，他也會繼續跟進此案，一旦發現孩子被通過不合法的程序領養，他將要求警方介入，對付買賣孩童的雙方！

他說，自從開始著手處理此案后，他對于此案存有許多疑點，他相信或有心懷不軌者企圖從中獲取利益，而誓要將孩子奪走。

“我處理此案純粹為了孩子的未來著想，我不想年少不知事的夫妻任人擺布。”

他說，他將會與該部的法律顧問團深入研究此案，以便從法律的角度去追究，對付有不良企圖者。

女方獨自行事
蘇吉祥不滿拒驗血

男女雙方連抽血也起爭執，令驗血工作一度停滯不前！

無論如何，在張天賜勸解下，男方最終還是自己付費去診所抽血，相信在未來兩週內，孩子的身分將水落石出。

蘇吉祥今午原本已準備接受驗血化驗脫氧核糖核酸，可是，女方卻堅決不要與他一起去抽血化驗，並指要分開抽血，並各自送往靈市化驗局，造成蘇吉祥與母親袁利鳳因擔心會有人“做手腳”而拒絕。

女方家人是于今午2時許，在郭素沁的陪同下前往診所抽血，可是，他們當時並沒有聯絡男方，也沒有知會男方，只是單方面行事。

結果，男方家人在同樣時間見張天賜時，被告知對方已前往抽血，令他們感到不滿，並指此舉並不透明。

在一度爭執不下后，男方在張天賜的勸解下最終還是接受，並于下午到診所抽血，送往靈市化驗局處理。

據瞭解，靈市化驗局將會接手化驗男女雙方及嬰兒的血液脫氧核糖核酸的工作，由于此案屬個別案例，他們也將免除一切收費。

此外，蘇吉祥說，孩子出世當天，雙方家長是在院方一名代表的見證下，為孩子申請報生紙，如今女方竟卻也拿來反咬一口，指責遭強逼，令他不解。

他今天重申，事情發展至今天地步，他仍無法放下陪同他渡過4個月的孩子，因此為了這名孩子，就算證明孩子不是他親生，只要林淑微願意抱著孩子回到他身邊，他將會重新接受他們母子。

找便宜爸爸
女方：錯誤的開始

女方承認，把已懷孕的林淑薇硬嫁給蘇吉祥，是一個錯誤的開始。

她們也很明白要蘇吉祥當“便宜父親”，對蘇吉祥極不公平，不過，在這方面，蘇吉祥也要付上一定責任。

女方在記者會上承認，當他們知道淑薇懷孕，且找不到藍田種玉人時，真如熱鍋螞蟻般著急，偏偏這時蘇吉祥洋洋得意地對外宣布，淑薇的處女之身已被他“攻破”，于是淑薇父親就順水推舟，找上蘇吉祥。

他們說，由于男女方皆住在文良港一帶，“淑薇獻身吉祥”消息傳開后，淑薇的父親只好迫著女兒下嫁蘇吉祥，迫他吃下這隻“死貓”。

“當時淑薇根本不想嫁給蘇吉祥，因為蘇吉祥也是對淑薇沒有感情，心目中還有其他女人。 ”

詢及若證實蘇志健并非蘇吉祥骨肉，可能會遭男方要求名譽賠償時？林淑薇的母親陳美娟不願置評。

另一方面，郭素沁說，她不想和張天賜在記者會上掀開罵戰，她只是依據法律程序處理“女方闖婆家搶嬰兒案”。

亞祥不求上進
被逼抱兒離去

林淑薇坦承未曾對蘇吉祥動過真感情，況且蘇吉祥不是孩子的爸，加上對方不求上進，所以決定抱著孩子逃離這個家。

林淑薇說，蘇吉祥雖比她年長兩歲，卻不求上進，不肯工作，而且沉迷網座電腦游戲，還搶走她的私房錢和在外惹事生非，令她心灰意冷。

此外，婆家也經常鬧窮，不時和外家借錢，所以，她覺得留在蘇吉祥身邊，沒有安全感，也看不到未來，加上不曾愛過蘇吉祥，所以決定抱著兒子蘇志健一起離開。

出於同情幫助
淑薇阿姨：沒私心

林淑薇的阿姨陳美麗說，她熱心幫助外甥女林淑薇，乃出於同情心，並沒有任何私心。

她說，當初淑薇懷孕后，女方絕大部分親屬已知道孩子並非蘇家的，可是淑薇的父親堅持要把女兒嫁進蘇家，才會鬧出今日無法收拾的局面。

“我也是兩名孩子的母親，我也看著淑薇帶著百般不願，嫁進蘇家，我多么同情淑薇的遭遇。”

在整個風波上，陳美麗和丈夫都一直遭人在背后指指點點，指她們離間蘇吉祥和林淑薇這對夫婦，從中得到好處，令他們承受壓力。
