Parliament 17 April 2012: Winding up speech on new Security Offences (Special Measures) Bill

The law, to replace the ISA, but which allows the police to detain a person for a maximum of 28 days for ‘investigation purposes’, is being debated now at parliament as Minister in PM’s dept. Nazri Aziz presents his winding up speech on the Bill.

It’s chaos, as it usually is when it comes to debating such Bills which are flawed and which is always pushed through without acknowledging and acting on the weaknesses in the Bill.

There will also be some amendments to some existing laws, in view of the ISA repeal move and the Security Offences Bill introduction, such as the Evidence Act 1950, Penal Code and the Criminal Procedure Code.

Some concerns of misusing the Bill, which is in principle a ‘counter-terrorism’ measure, as raised by MPs and even Suhakam are:

– Arrest without warrant by Police

– There is no judicial oversight of the 28-day detention period

– There is no immediate access for a detainee to legal representation (f0r up to 48 hours).

– The use of an electronic monitoring device (anklet) placed on detainees following the detainees’ release, if investigations are not over

– The interception of communications

– The absence of bail to those charged with a ‘security offence’

(one of the amendment to the Evidence Act)

– Admissible submission of a statement (written or oral) by a deceased person (or even someone who cannot be found)

    As I have predicted that all the repeals of the laws talked by the P.M. are just disguise of old wine in new bottles. That is what Najib is, keep on thinking that he is able to fool the people with the replacement for another 53 years.
    The only way out of all these deceptions is to vote this bunch of crooks out of Putrajaya in the coming GE and then have them and all their appointed lackeys such as the AG, IGP and the EC just to name a few, probed and then indicted for the countless atrocities they committed. The shambles must stop so come on out in the coming GE and vote these corrupted morons out of their ivory towers !
