ROS does not recognise Bersatu’s 12-member EGM

The Registrar of Societies (ROS) has described Bersatu’s meeting on Nov 2 last year as a “supreme council meeting” despite the party calling it an extraordinary general meeting (EGM).

“Bersatu said it held an EGM on Nov 2, 2016, but the fact is, it is only a supreme council meeting and not an EGM.

“The ROS has reviewed the meeting minutes of the 2016 Bersatu EGM and found that only 12 supreme council members were recorded to have attended,” said director-general Suriyati Ibrahim.

Bersatu had amended its constitution to change the name of its Youth wing from Bersatu Youth to Armada during this meeting.

Last week, the registrar said the use of the term Armada is against Bersatu’s constitution and can lead to the party’s de-registration.

At a press conference in Putrajaya today, Suriyati said because the Nov 2, 2016 meeting was not an EGM, it did not fulfil clause 28 of Bersatu constitution, which states that the constitution can only be amended with approval of two-thirds of delegates at either an EGM or annual general meeting (AGM).

Bersatu was registered as a party in September 2016 and had targetted to have 100,000 members by November that year.

An official membership figure around the time of the Nov 2 meeting is unavailable, although the party had touted that it had a very encouraging number of people registering to become members.

As of June this year, the party said it has 200,000 members.

Meanwhile, on Bersatu’s application to postpone its AGM, Suriyati said there was nothing in the party constitution that allowed for such a delay.

“The offence of not holding an AGM is also something that is very serious, as it violates Bersatu’s own constitution and can result in the party’s deregistration,” she said.

Bersatu secretary-general Shahruddin Md Salleh said that the party wants its AGM postponed until next year, to facilitate the setting up of its branches.

He said the party constitution states that the AGM can only be held after division meetings, which can’t be held until branches are fully set up and registered.
