Soalan: YB Puan Teresa Kok Suh Sim (Seputeh) minta Menteri Perumahan dan Kerajaan Tempatan menyatakan apakah Kementerian akan meminda Akta Jalan, Parit dan Bangunan 1974 untuk memudahkan pondok keselamatan sekuriti didirikan di kawasan perumahan dan membenarkan lebih kawasan perumahan diubah sebagai “komuniti terpagar” (gated community).

Untuk makluman Ahli Yang Berhormat, peruntukan yang membenarkan pembangunan komuniti berpagar atau gated community adalah di bawah Akta Hakmilik Strata 1984 dan Undang-Undang Kecil Bangunan Seragam 1984.
Pindaan Akta Hakmilik Strata 1985 yang berkuatkuasa pada 12 April 2007 telah menambah satu peruntukkan khusus bagi membenarkan penubuhan komuniti berpagar. Dengan adanya peruntukan ini, Jawatankuasa Penduduk atau Perbadanan Pengurusan adalah sah dari aspek perundangan untuk membina pagar dan palang jalan bagi kawasan skim berkenaan. Ini kerana perkara-perkara seperti jalan dan kawasan lapang adalah menjadi harta bersama di bawah pentadbiran perbadanan pengurusan bagi sesuatu skim komuniti berpagar.
Sehubungan dengan itu, Kementerian Perumahan dan Kerajaan Tempatan (KPKT) buat masa ini tidak berhasrat untuk meminda Akta Jalan, Parit dan Bangunan 1974 bagi membangunkan komuniti berpagar memandangkan undang-undang lain sedia ada didapati memadai.

Question: YB Puan Teresa Kok Suh Sim (Seputeh) asks the Minister for Housing and Local Government to state whether the Ministry will amend the Street, Drainage and Building Act 1974 to facilitate the building of security huts in residential areas and allow more residential areas to be converted into gated communities.

For the information of Yang Berhormat, the allowance which permits the setting up of a gated community falls under the Strata Titles Act 1984 and Uniform Building By-Law 1984.
The amendment to the Strata Titles Act 1985 which came into force on 12 April 2007 had added a particular allowance which permits the setting up of gated communities. With this amendment, the Resident’s Committee or the Management Body is recognised from a legal aspect to build fences and road barricades in the area of the scheme concerned. This is because issues such as the road and open land are jointly owned properties under the administration of the management body for a particular gated community scheme.
In relation to that, the Ministry of Housing and Local Government at this time has no intention to amend the Street, Drainage and Building Act 1974 to develop gated communities in view of the fact that other existing laws are found to be adequate.

My position statements:
1. We should NOT support setting up of ILLEGAL gated community who are blocking PUBLIC roads.
2. The root of the problem is Police failed. The govt failed.
Arguments :
1. This illegal gated community is set up on PUBLIC ROADS. The roads and parks and road shoulders are all managed by the town council. If the community wants gated community. The town council should DE-GAZETTE the roads and area as public road and area. And hand over the management/maintenance of the area to the community just like condos. And make the whole area PRIVATE AREA.
2. Illegal gated communities are opened to abuses. This companies setting up illegal gated communities are equivalent to collecting PROTECTION MONEY! And they might very well be working with the crooks. Or they are the crooks themselves. Why bother breaking into house when you can collect money “legally” from them?
3. Police force fails, can I build my own private police force?
4. Politicians should not look for easy way out by encouraging ILLEGAL gated community just like the police.
Compromise :
1. While the police have failed, the state govt should make it clear that all this illegal gated communities on PUBLIC ROADS should be removed and not allowed to set up anymore after the crime rate goes down.
2. The state govt should make it clear that building pondoks on the road shoulder and setting up illegal road blocks on public roads is ILLEGAL.
If the above is not the position of the state govt. What is there to stop me from building my house on an empty land and call it my gated community?

This is a follow up on the illegal gated community ( http://bit.ly/3L4obt ). In-fact it is actually not gated community. It is just gated.
This questions I ask specific to the MBPJ councillors and Selangor State Govt.

There’s a Dewan Serbaguna at the intersection of SS21/12 and SS21/5 and also a field there. Obviously this Dewan Serbaguna is a public entity under MBPJ.
Now, the Dewan Serbaguna happens to be smack in the middle of a illegal gated area. Which is gated 24/7, and the pak guards stop ppl at the entrance.
Question to the MBPJ and Selangor State Govt, have the Dewan Serbaguna being privatise? Why should public face harassment from illegal pak guards from going to a public place? Why is it being “gated up” by a third party?
There is alot of activities happening near Taman Desa. I can see alot of “transaction” happening lately around 2am along Jalan Kelang Lama after police block. Even myself was asked by police why do i need a stick to be placed in my car. Obvious reason is that social security sucked big time and police have failed horribly to ensure security at present, but instead i was told that i am the one that is dangerous to general public. Since when having late supper is a crime ? I am just an ordinary working class resident in Taman Desa and kinda shocked to hear this coming from PDRM. What can i do? Complained to PDRM?
